1. ABOUT THIS RETURNS POLICY

This Returns Policy explains how returns, refunds, cancellations and transaction problems are handled for artwork and other items purchased through the Bidlet website, application and marketplace (Platform).

This Policy forms part of the Bidlet Terms of Service. If there is an inconsistency between this Policy and a non-excludable legal right, the non-excludable legal right will apply.

Bidlet provides marketplace and payment-support services. Unless the checkout or listing states otherwise, the Creator or Seller is the seller of the artwork, and Bidlet provides the platform used to submit and manage a return request.

2. YOUR LEGAL RIGHTS

Nothing in this Policy excludes, restricts or modifies any right, guarantee, remedy or protection that cannot lawfully be excluded or limited.

If Australian Consumer Law applies, a buyer may have rights where artwork or another item is not of acceptable quality, does not match its description or sample, is not fit for a disclosed purpose, is not delivered as agreed, or otherwise fails to meet a consumer guarantee.

A buyer may be entitled to a refund, replacement, repair, price reduction or another remedy depending on the circumstances and the seriousness of the problem. These rights are separate from any voluntary return option described in this Policy.

3. WHEN A RETURN OR REFUND MAY BE AVAILABLE

A return, replacement, refund or other remedy may be available where:

- the artwork is materially different from its listing description or photographs;
- the wrong item was sent;
- the artwork arrived damaged, defective or unsafe;
- the artwork was not delivered within the agreed period or is confirmed lost;
- the order was charged more than once because of a payment or system error;
- the transaction was unauthorised, subject to verification;
- the Creator or Bidlet cancelled the order before delivery;
- the listing or transaction contained a material error;
- the item is eligible for a change-of-mind return under the listing or a separate Bidlet return offer; or
- another remedy is required under applicable law.

A return is not automatically available merely because a buyer changes their mind. Change-of-mind returns depend on the relevant listing, the type and condition of the item, the timing of the request and applicable law.

4. ITEMS THAT MAY NOT BE RETURNABLE

A return or refund may be refused where permitted by law if:

- the buyer changes their mind and no change-of-mind return applies;
- the item was made or customised specifically for the buyer;
- the item was altered, damaged, used improperly or materially changed after delivery;
- the buyer cannot return the item in a condition reasonably consistent with inspection;
- the buyer provides an incorrect delivery address or fails to collect the item;
- the buyer has not paid the full amount due;
- the request is outside the applicable time period and no non-excludable legal right applies;
- the claim is unsupported, misleading, fraudulent or abusive;
- the buyer has already received and accepted an agreed remedy for the same issue; or
- the order concerns a digital service, account credit, commission, earning, reward or other intangible item that has already been provided, except where a refund is required by law.

These exclusions do not apply where the item is faulty, unsafe, materially misdescribed or otherwise covered by a non-excludable consumer guarantee.

5. HOW TO REQUEST A RETURN USING THE NEW RETURNS FEATURE

To submit a return request through Bidlet:

1. Sign in to the Bidlet account used for the purchase.
2. Open the Bidlet Returns page.
3. Select the item or purchase you want to return.
4. Choose or enter the reason for the return.
5. Provide the requested description, photographs, order information and other evidence.
6. Submit the request through the Platform.
7. Monitor the request under “Your Return Requests” for messages, status updates and next steps.

The returns feature is connected to the buyer’s account and purchase history. A buyer must be logged in to request a return. If a purchase does not appear, the buyer should contact Bidlet at hello@bidlet.app and provide the order reference without including unnecessary sensitive information.

A return request is not an automatic approval. Submission allows Bidlet and, where relevant, the Creator, payment provider or delivery provider to review the issue and determine the appropriate outcome.

6. INFORMATION TO INCLUDE IN A RETURN REQUEST

A buyer should provide:

- the order or transaction reference;
- the item name and Creator or Seller name;
- the date of purchase and date of delivery, if known;
- the reason for the request;
- a clear description of the problem;
- photographs of the artwork, packaging and shipping label where relevant;
- delivery or tracking information where relevant; and
- the outcome the buyer is requesting, such as a return, replacement, repair, refund or other remedy.

Bidlet may request additional information reasonably needed to verify the purchase, assess the condition of the item, investigate damage or fraud, or comply with a payment provider’s requirements.

7. RETURN TIME PERIODS

A buyer should submit a return request as soon as reasonably possible after discovering the problem and, unless a longer period is required by law, within seven days after delivery or after the buyer becomes aware of the issue.

The relevant listing, checkout page or order communication may state a different return period. If it does, that period applies to any voluntary return option, subject to non-excludable legal rights.

A delay in making a request may affect the ability to investigate damage, delivery or condition. A delay does not remove a legal right that cannot lawfully be excluded.

8. REVIEW AND RETURN DECISION

After a return request is submitted, Bidlet may:

- acknowledge the request through the Platform or by email;
- ask the buyer, Creator or delivery provider for further information;
- review listing information, order records, payment records, delivery records and delivery-confirmation data;
- ask for photographs, video or other evidence;
- provide return instructions;
- approve or decline a return request;
- offer a repair, replacement, refund, partial refund, credit or another remedy;
- refer the request to the Creator, payment provider or delivery provider; or
- keep the request open while additional information is obtained.

A return request may be approved, declined or resolved in stages. Bidlet will communicate the decision and any required next step through the Platform, email or another available support channel.

Bidlet aims to acknowledge a return request within five business days. The time needed for a final decision may be longer where the request involves delivery investigation, Creator input, payment-provider review, fraud checks, a return shipment or a complex condition assessment.

9. RETURN AUTHORISATION AND SHIPPING THE ITEM BACK

A buyer must not send artwork back unless Bidlet or the Creator provides return instructions or applicable law permits the buyer to return it without prior authorisation.

Where a return is approved, the instructions may specify:

- the return address;
- the carrier or delivery method;
- the return deadline;
- packaging requirements;
- tracking or insurance requirements; and
- who is responsible for return shipping.

The buyer must package the artwork carefully and use the return method stated in the instructions. The buyer should keep the postage receipt and tracking information until the request is completed.

If the artwork is returned because it is faulty, damaged before delivery, materially misdescribed or another legal remedy applies, Bidlet or the responsible Seller will arrange or reimburse reasonable return shipping costs as required by law or stated in the return instructions.

If the return is a permitted change-of-mind return, the buyer may be responsible for return shipping, original delivery charges or other stated costs unless the listing or applicable law provides otherwise.

10. DELIVERY CONFIRMATION AND QR CODES

Bidlet may use delivery confirmation, including a QR code or confirmation token attached to the product package, to record that an item has been delivered and to support Creator payout processing.

A buyer should confirm delivery only after receiving the relevant package. A QR confirmation is not a waiver of rights and does not prevent a buyer from reporting damage, a material mismatch, non-delivery, fraud or another issue.

If a QR confirmation cannot be completed, the Platform may display a message such as “Missing confirmation QR token — please rescan the product package.” The buyer should rescan the package using the correct Bidlet process or contact Bidlet if the token is missing, damaged or does not work.

A delivery confirmation may be considered as evidence during a return review, but it is not conclusive where other evidence shows that an item was damaged, misdescribed, unsafe, incomplete or not received by the buyer.

11. INSPECTION AND CONDITION OF RETURNED ITEMS

Returned artwork may be inspected by Bidlet, the Creator, a delivery provider or another authorised service provider to assess the reported issue and confirm the condition of the item.

The buyer must not intentionally damage, alter, repair, clean, frame, dismantle or otherwise change the artwork after submitting a return request unless Bidlet gives permission or the action is reasonably necessary to prevent further damage.

A buyer should return the artwork with its original packaging, accessories, certificates and other included materials where reasonably possible. Missing materials or damage caused after delivery may affect a voluntary return remedy, but do not remove non-excludable legal rights.

12. REFUNDS AND OTHER OUTCOMES

If a return is approved, the available outcome may include:

- a full refund;
- a partial refund or price reduction;
- a replacement or exchange;
- repair or restoration where appropriate;
- reimbursement of reasonable return delivery costs;
- cancellation of an order before delivery;
- a Bidlet account credit where the buyer agrees and the law permits; or
- another outcome required by law or agreed with the buyer.

A refund will generally be made to the original payment method. Processing time depends on the payment provider, bank and payment method. Bidlet may deduct or delay a refund only where permitted by law, such as where an approved return has not been received, an amount is disputed, a chargeback is open or the buyer has agreed to another remedy.

Account credits are not a substitute for a cash refund where a cash refund is required by law. Any voluntary credit will be subject to the conditions shown when it is offered.

13. AUCTION PURCHASES

Artwork purchased through a public bid or silent auction is subject to this Policy and the auction-specific rules displayed on the listing or checkout page.

Winning an auction does not remove non-excludable consumer rights. A return or refund for change of mind is not available unless the auction listing or applicable law provides for it.

If an auction item is faulty, materially misdescribed, not delivered or otherwise covered by a legal remedy, the buyer should submit a return request through the Bidlet Returns page using the account connected to the winning purchase.

14. SELLER AND CREATOR RESPONSIBILITIES

Creators and Sellers must:

- describe artwork accurately;
- disclose known defects, damage, alterations, limitations and reproduction status;
- package artwork safely;
- dispatch orders within the stated period;
- cooperate with return requests and investigations;
- provide information reasonably requested by Bidlet; and
- comply with applicable consumer, product-safety, intellectual-property and tax laws.

A Creator or Seller must not pressure a buyer to withdraw a legitimate return request, provide false information, interfere with the return feature, or attempt to resolve a Platform transaction through an unsafe or unauthorised off-platform payment.

Bidlet may hold, delay, reverse or adjust a payout while a return, refund, chargeback, delivery issue, fraud report or other transaction dispute is investigated, subject to applicable law.

15. UNAUTHORISED TRANSACTIONS AND PAYMENT DISPUTES

If a buyer believes that an order or payment was unauthorised, the buyer should submit a return or transaction report through Bidlet and contact the relevant payment provider or bank promptly.

Bidlet may request account, device, transaction and identity information to investigate an unauthorised transaction. A payment-provider chargeback does not prevent Bidlet from reviewing the underlying order, return request or account activity.

False refund claims, chargeback abuse, account manipulation or other fraudulent activity may result in denial of a request, account restrictions, reversal of improperly obtained funds or referral to a payment provider or relevant authority.

16. CANCELLATIONS BEFORE DISPATCH

A buyer may request cancellation before an order is dispatched, but cancellation is not guaranteed. Bidlet or the Creator may accept or decline the request depending on the order status, listing terms and applicable law.

If an order is cancelled before dispatch and payment has been taken, Bidlet will arrange a refund where appropriate. If the order has already been dispatched, the buyer should use the returns feature instead of treating the order as cancelled.

17. NON-DELIVERY, LOSS AND DAMAGE IN TRANSIT

A buyer should report non-delivery, suspected loss or transit damage through the returns feature or by contacting hello@bidlet.app.

For damage claims, the buyer should keep the artwork, packaging, shipping label and other relevant materials until Bidlet or the delivery provider gives further instructions.

Bidlet may request tracking information, delivery records, photographs, QR-confirmation information and statements from the buyer, Creator or carrier. The responsible party and available remedy depend on the delivery terms, the cause of the loss or damage and applicable law.

18. CONTACT AND SUPPORT

The preferred method for requesting a return is the logged-in Bidlet Returns feature:

1. Sign in.
2. Open the Returns page.
3. Select the purchase.
4. State the reason.
5. Submit the request.
6. Track the request under “Your Return Requests.”

19. POLICY CHANGES

Bidlet may update this Returns Policy to reflect changes to the Platform, the returns feature, payment providers, delivery processes, applicable law or operational practice.

The updated version will show a new effective date. Changes will not remove a non-excludable legal right or alter an already accepted return outcome unless permitted by law.

END OF RETURNS POLICY

This Policy should be reviewed by a qualified Australian consumer-law lawyer before publication, particularly the return time periods, change-of-mind rules, Australian Consumer Law remedies, auction transactions, payment-provider procedures, QR delivery confirmation, shipping-cost allocation and Creator payout holds.

- the artwork is materially different from its listing description or photographs;
- the wrong item was sent;
- the artwork arrived damaged, defective or unsafe;
- the artwork was not delivered within the agreed period or is confirmed lost;
- the order was charged more than once because of a payment or system error;

- the buyer changes their mind and no change-of-mind return applies;
- the item was made or customised specifically for the buyer;
- the item was altered, damaged, used improperly or materially changed after delivery;
- the buyer cannot return the item in a condition reasonably consistent with inspection;

- the order or transaction reference;
- the item name and Creator or Seller name;
- the date of purchase and date of delivery, if known;
- the reason for the request;
- a clear description of the problem;
- photographs of the artwork, packaging and shipping label where relevant;

- acknowledge the request through the Platform or by email;
- ask the buyer, Creator or delivery provider for further information;
- review listing information, order records, payment records, delivery records and delivery-confirmation data;
- ask for photographs, video or other evidence;
- provide return instructions;
- approve or decline a return request;
- offer a repair, replacement, refund, partial refund, credit or another remedy;

- the return address;
- the carrier or delivery method;
- the return deadline;
- packaging requirements;

- a full refund;
- a partial refund or price reduction;
- a replacement or exchange;
- repair or restoration where appropriate;
- reimbursement of reasonable return delivery costs;
- cancellation of an order before delivery;

- describe artwork accurately;
- disclose known defects, damage, alterations, limitations and reproduction status;
- package artwork safely;
- dispatch orders within the stated period;
- cooperate with return requests and investigations;
